Legislative Directives 1. Mechanics Lien Statute extending lien rights to surveyors. (Illinois extends lien rights to surveyors, property managers and real estate brokers.) 2. Require a survey to be completed within 12 years prior to the transfer of land title. 3. Right-of-Entry / Trespass for completion of surveys. 4. Require government / municipal employees that review and approve right-of-way, subdivision and boundary plans to be licensed as Professional Land Surveyors. 5. Legislation granting municipalities, townships and boroughs the authority to mandate a boundary survey as a condition for the issuance of building permits and fence permits.
Directives for the State Board 1. Require all monumentation to depict the responsible Surveyor’s license number. 2. Mortgage survey clarification. Replace mortgage surveys with full property survey. 3. Establish and issue guidelines ensuring reasonableness and uniformity in Surveyors’ certifications on subdivision plans. 4. Establish mandate requiring recording of survey plans with deeds. 5. Require responsibility for GIS base mapping by a Professional Land Surveyor. 6. Require supervision of GPS control surveys by a Professional Land Surveyor.
Successful Initiatives 1. Institute a statute of limitations of 12 years from completion of survey for liability—PASSED: House Bill 496 (2005). 2. Implement penalty for failure to set monuments and for destruction of property markers—PASSED: House Bill 496 (2005).
